Terms of Service
By downloading or using CurlCast, you agree to these terms. Please read them — they're short.
1. Acceptance of these terms
These Terms of Service (“Terms”) are a legal agreement between you and CurlCast (“CurlCast”, “we”, “us”). By installing or using the app, you agree to be bound by these Terms and by our Privacy Policy. If you don't agree, don't use CurlCast.
2. Eligibility
CurlCast is intended for users aged 13 and above. If you're under the age of majority where you live, you may only use CurlCast with the consent of a parent or guardian.
3. License to use CurlCast
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use CurlCast on devices you own or control for your own personal, non-commercial use. All rights not expressly granted are reserved.
You agree not to:
- Reverse engineer, decompile, or disassemble the app, except where the law expressly allows it.
- Sell, resell, rent, lease, or sublicense the app.
- Remove or alter any proprietary notices.
- Use the app to build a competing product.
4. Subscriptions and billing
CurlCast does not require an account, but it does require an active CurlCast+ subscription to use. CurlCast is free to download, and new subscribers begin with a 3-day free trial; no payment is taken during the trial. CurlCast+ is an auto-renewing subscription offered at $1.99 per week or $29.99 per year. Introductory free trials are limited to one per Apple Account per subscription group, so a customer who has already used the CurlCast+ trial will be charged at the start of the period. Payment is charged to your Apple Account at confirmation of purchase, or at the end of the free trial. Unless canceled at least 24 hours before the end of the current period, the subscription renews automatically at the same price, and a free trial converts to a paid subscription on the plan you selected. If your subscription lapses, access to forecasts ends, though your saved hair profile remains on your device. You can manage or cancel a subscription at any time in your Apple Account settings. Purchases are processed by Apple and are subject to Apple's terms; refund requests are handled by Apple, not by us.
5. Acceptable use
You agree not to use CurlCast in a way that:
- Violates any law or third-party right.
- Attempts to interfere with, disrupt, or gain unauthorized access to the service or its infrastructure.
- Introduces malware, scrapers, or automated tools that exceed reasonable use.
- Impersonates another person or misrepresents your affiliation with any person or entity.
6. Third-party data
CurlCast uses weather data from Open-Meteo. That data is provided under Open-Meteo's own terms and is offered on an “as is” basis. CurlCast is not responsible for the accuracy, timeliness, or availability of third-party data.
7. Disclaimer — this is not professional hair advice
CurlCast is an informational and decision-support tool. It is not a substitute for professional advice from a licensed hair stylist, cosmetologist, or dermatologist. Use your own judgment when making styling decisions.
To the fullest extent permitted by law, CurlCast is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of results.
8. Limitation of liability
To the fullest extent permitted by law, CurlCast, its owners, and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to damaged hair, missed appointments, or ruined blowouts — arising from your use of the app. Our total liability, in the aggregate, will not exceed the amount you paid us in the 12 months before the claim (which, for a free app, is zero).
Some jurisdictions do not allow the exclusion of certain warranties or liability limits, so parts of this section may not apply to you.
9. Termination
You can stop using CurlCast at any time by deleting the app and canceling any active subscription in your Apple Account settings. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (disclaimers, liability limits, governing law) will survive.
10. Governing law and disputes
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in New York County, New York, and you consent to their personal jurisdiction and venue. Nothing in these Terms affects consumer rights that cannot be waived under applicable law.
11. Changes to these terms
We may update these Terms from time to time. If changes are material, we'll update the “last updated” date and, where required, notify you inside the app. Continued use of CurlCast after changes take effect means you accept the revised Terms.
